1. Introduction
1.1 At PMA, we are committed to protecting your privacy and to ensuring that your personal information is collected and used properly, lawfully and transparently.
1.2 The Privacy Notice explains how Prosperity Management Africa (Pty) Ltd (“PMA”) obtains, uses and discloses your personal information, in accordance with the requirements of the Protection of Personal Information Act, 4 of 2013 (“POPI Act”).

2. Who we are
PMA is a specialist group life insurance underwriting manager and risk benefit product provider. Our senior executive management team will work directly with the client and its advisors to tailor all products and policies in accordance with the specified requirements. PMA further enables its clients to gain access to specialised and cost-effective pricing models through cell-captive and reinsurance structures.

3. The type of personal information we collect
We collect and process your personal information mainly for the purposes of understanding our clients’ requirements and delivering services accordingly.

4. How we get the personal information and what we use it for
4.1 Most of the personal information we process is provided to us by our clients, who have obtained the information directly from. We also receive personal information indirectly from our website usage information using “cookies” which allow us to collect standard internet visitor usage information.
4.2 We use the information provided to us only for the purposes for which it was collected and agreed between PMA, our clients and you, as the case may be
4.3 We may share this information with third parties/operators or the relevant internal departments attending to an enquiry. PMA will ensure that anyone to whom we pass your personal information agrees to treat your information with the same level of security and confidentiality as we are obliged to.

5. When will we process personal information
In accordance with the terms of the POPI Act, we base our processing on the following grounds:

5.1 The data subject, or a competent person where the data subject is a child, consents to the processing (which consent can be withdrawn at any time);
5.2 The processing is necessary to carry out actions for the conclusion or performance of a contract to which the data subject is a party;
5.3 The processing complies with an obligation imposed by law on PMA;
5.4 The processing protects a legitimate interest of the data subject;
5.5 The processing is necessary for the proper performance of a public law duty by PMA; or
5.6 The processing is necessary for pursuing the legitimate interests of PMA or of a third party/operator to whom the information is supplied.

6. How we store personal information
6.1 The information is securely stored by our document storage and information management service providers and is protected by our cyber security specialists.
6.2 In accordance with the Financial Advisory and Intermediary Services Act, 37 of 2002, PMA is obligated to retain personal information for five years following the date on which the services rendered by PMA in respect of the data subject have been brought to finality.
6.3 We will then dispose of your information securely once the legislatively mandated retention period has expired. The information will be disposed of correctly in line with PMA’s data destruction policy and applicable legislation, ensuring the proper destruction and removal of data in such a way that it will no longer be accessible or retrievable.

7. Data protection rights
7.1 Access to personal information must be requested in accordance with the procedures set out in PMA’s PAIA Manual. A request may also be made for PMA to correct or supplement or destroy any personal information.
7.2 PMA’s Information Officer/Deputy Information Officer will consider any such request in light of all applicable laws relating to the collection, retention, and destruction of personal information. Unless good cause is shown as to why a request must be resolved sooner, PMA will respond to a request within 30 days of receipt.
